About these terms
These Terms of Use are an agreement between you and Antoine Vaessen ("Frigomi", "we", "us"). They apply to the Frigomi iPhone app and to the website frigo-app.org.
By using Frigomi you accept these terms. If you don't agree, please don't use Frigomi. Our Privacy Policy explains how we handle your personal data.
Using Frigomi
- Age. You must be at least 13 to use Frigomi.
- Your account. The taste quiz works without an account. To scan your fridge and save recipes you create an account with Apple or email, because your fridge, cookbook and free allowance live in it. Keep your sign-in details safe: you're responsible for what happens in your account. Tell us if you think someone else is using it. One free allowance per person: the free scans and free rolls of invented ideas are tied to your email address, so a new account with the same address (or a variation of it) doesn't get them again.
- Your licence. We give you a personal, non-exclusive, non-transferable licence to use Frigomi on the Apple devices you own or control, for your own non-commercial use, as allowed by these terms and the Usage Rules of the Apple Media Services Terms and Conditions.
Frigomi Plus
- What it is. Frigomi Plus is an optional subscription that unlocks unlimited scans, unlimited ideas and Ask Frigomi questions, estimated nutrition and family profiles. "Unlimited" means everyday personal use, with a fair-use ceiling per account (currently 5 scans, 40 rounds of ideas and 60 questions a day, and 100 newly written ideas a week) that protects the service from abuse. The free plan includes 3 fridge scans and 3 rolls of freshly invented ideas in total (a scan only counts once it works), unlimited ideas from the Frigomi cookbook and 3 Ask Frigomi questions a week; adding food by hand, your saved recipes and cooking from your saved fridge stay free.
- Price and billing. The price and billing period are shown in the app before you buy. Payment is charged to your Apple ID when you confirm the purchase.
- Free trial. If a free trial is offered, you're charged when the trial ends unless you cancel at least 24 hours before it ends.
- Automatic renewal. Your subscription renews automatically for the same period and price unless you turn off auto-renew at least 24 hours before the end of the current period. You can manage or cancel it anytime in Settings › [your name] › Subscriptions on your iPhone. Cancelling stops the next renewal; you keep Plus until the end of the period you've paid for.
- Refunds. Purchases are processed by Apple, so refunds are handled by Apple under its policies, at reportaproblem.apple.com. If you're a consumer in the EU, this includes your statutory right of withdrawal as applied by Apple.
- Price changes. If the price changes, Apple will let you know in advance and, where required, ask for your consent before you're charged the new price.
- Restoring purchases. On a new device, use Me › Settings › Restore purchases.
AI recipes, allergies and food safety
Frigomi uses artificial intelligence to identify ingredients in your photos and to write recipes, swaps and answers. All of it is generated by AI, and AI can be wrong. It can mistake one ingredient for another, miss something, or suggest something that doesn't suit you.
- Allergies. Frigomi treats the allergies you enter as hard rules and checks every recipe, swap and answer against them. It is still an aid, not a guarantee. Always read product labels, watch out for cross-contamination and, if an allergy is severe, check every ingredient yourself before cooking or eating.
- Food safety. Use your own judgement: check that food is still good to eat, cook meat, fish and eggs thoroughly, and follow the storage advice on packaging. Freshness indications in Frigomi ("~2 days") are typical estimates, not use-by dates.
- Estimates. Nutrition figures, money saved and quantities are estimates for information only.
- Not medical advice. Frigomi does not give medical, dietary or nutritional advice. If you follow a diet for health reasons, talk to a professional.
- Report problems. If a recipe or an Ask Frigomi answer looks wrong or unsafe, tell us with "Report a problem" on the recipe or "Report this answer" under the answer. We read every report.
Your content
The photos, ratings and notes you add remain yours. You give us a limited, worldwide licence to store, process and display them only to run Frigomi for you (for example, to analyse a photo or show your cooking journal), for as long as they're in your account. We don't use your photos to advertise and we don't publish them. When you delete your content or your account, this licence ends.
Only add content you have the right to share, and don't include other people's personal information in your photos.
Fair use
Please don't:
- use Frigomi for anything illegal or harmful,
- try to access other people's data, disrupt the service or get around its limits (including the free scan limit),
- copy, resell or build a competing service from Frigomi, its recipes or its artwork,
- reverse-engineer the app, except where the law allows it,
- use automated means (bots, scrapers) to access Frigomi,
- upload content that is offensive, infringes someone's rights or contains malware.
We may suspend or close an account that seriously or repeatedly breaks these rules. Where reasonable, we'll warn you first.
Our intellectual property
Frigomi, its name, logo, mascot, stickers, design and software belong to us or our licensors. Apart from the licence in section 2, these terms don't give you any rights to them.
Changes and availability
We keep improving Frigomi, so features may change. We'll do our best to keep it running, but it may sometimes be unavailable, for example during maintenance. If we ever stop offering Frigomi, we'll tell you in advance, and Apple subscriptions will stop renewing.
We may update these terms, for example when we add features or the law changes. We'll update the date at the top and, if the change matters, tell you in the app before it applies. If you don't agree with the new terms, you can stop using Frigomi and delete your account.
Liability
We build Frigomi with care, but it's provided "as is". To the extent the law allows, we're not liable for indirect losses, or for losses caused by relying on AI suggestions without the checks described in section 4.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for intentional or gross misconduct, or any liability that can't be limited by law. If you're a consumer, you keep all the rights consumer protection law gives you, including your legal guarantee that digital content works as described.
Ending the agreement
You can stop using Frigomi at any time and delete your account in Me › Settings › Delete account. Deleting your account doesn't cancel an Apple subscription: cancel it in your App Store settings too. We may end this agreement if you seriously break these terms, as described in section 6.
App Store terms
If you downloaded Frigomi from Apple's App Store, you also agree to the following:
- Acknowledgement. These terms are between you and us only, not Apple. We, not Apple, are solely responsible for Frigomi and its content.
- Maintenance and support. We are solely responsible for maintaining and supporting Frigomi. Apple has no obligation to provide any maintenance or support for it.
- Warranty. If Frigomi fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Frigomi to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Frigomi. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent they are not excluded by these terms.
- Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to Frigomi or your use of it, including product liability claims, claims that Frigomi fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that Frigomi or your use of it infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms. You must comply with any applicable third-party terms when using Frigomi, such as your mobile data plan.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
Questions, complaints or claims about Frigomi go to us: Antoine Vaessen, antoinevaessen@icloud.com.
Law and disputes
These terms are governed by Belgian law. If you're a consumer living in the EU, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim in the courts of that country or of Belgium.
If something goes wrong, please write to us first at antoinevaessen@icloud.com: we'll do our best to sort it out quickly and fairly.
